Powers of attorney
If for some reason you are not able to manage your own financial affairs or able to make decisions relating to your personal welfare it is likely that the court of protection will step in and appoint someone to act on your behalf. This can be a lengthy, stressful and expensive process and the person appointed by the court may not be the person that you would have chosen.
A Lasting Power of Attorney 'LPA' authorises someone else to look after either your financial affairs, your personal welfare or both on your behalf. This may become necessary if you are unable to manage your own financial affairs or make decisions relating to your personal welfare due to an accident or illness.
You can appoint an Attorney to look after all of your financial affairs or aspects of them.
People also make LPA's for immediate use when they are still perfectly capable of looking after their financial affairs but no longer wish to, for example, when they move into a nursing home. Decisions relating to your personal welfare cannot be made on your behalf unless you are unable to make your own decision.
